人社部關于做好高溫天氣勞動者權益保障工作的通知

    近期(qi),全國多地出現持續高溫天(tian)氣(qi),部(bu)分地區遭遇極端高溫。為(wei)做好高溫天(tian)氣(qi)勞動者(zhe)權益保障工作,現就有(you)關事(shi)項通知(zhi)如下(xia):


   一、高度重視高溫天氣勞(lao)動者(zhe)權益保障(zhang)工作

   高溫天氣(qi)勞動者權益保障(zhang)事關勞動者身體健康和生(sheng)命安(an)全。各地要立即行(xing)動起(qi)來,以(yi)時時放心不下(xia)的責任感,加強組織領導,明(ming)確(que)責任分(fen)工,密切(qie)協同配合,壓(ya)緊壓(ya)實(shi)企業主體責任,抓實(shi)抓細工作落實(shi),全力保障(zhang)勞動者合法權益。 

   二、指導規范高溫天氣(qi)工作時(shi)間規定

   指(zhi)導督促(cu)企業(ye)做好(hao)高(gao)(gao)溫(wen)(wen)天(tian)氣(qi)(qi)期間的生產組(zu)織和(he)管理,合(he)理安排(pai)(pai)(pai)勞動(dong)(dong)(dong)者(zhe)在(zai)高(gao)(gao)溫(wen)(wen)天(tian)氣(qi)(qi)下的戶(hu)外(wai)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)時(shi)(shi)(shi)間,盡量(liang)避(bi)開酷熱時(shi)(shi)(shi)段(duan)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye),適(shi)當增加勞動(dong)(dong)(dong)者(zhe)休(xiu)息(xi)時(shi)(shi)(shi)間和(he)輪換班次。地(di)市級以(yi)(yi)(yi)上(shang)氣(qi)(qi)象(xiang)主管部門所(suo)屬氣(qi)(qi)象(xiang)臺發布日(ri)(ri)(ri)預報氣(qi)(qi)溫(wen)(wen)最高(gao)(gao)達(da)(da)到40℃以(yi)(yi)(yi)上(shang)時(shi)(shi)(shi),停止(zhi)安排(pai)(pai)(pai)勞動(dong)(dong)(dong)者(zhe)進行室(shi)(shi)外(wai)露(lu)天(tian)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye);日(ri)(ri)(ri)最高(gao)(gao)氣(qi)(qi)溫(wen)(wen)達(da)(da)到37℃以(yi)(yi)(yi)上(shang)、40℃以(yi)(yi)(yi)下時(shi)(shi)(shi),安排(pai)(pai)(pai)勞動(dong)(dong)(dong)者(zhe)室(shi)(shi)外(wai)露(lu)天(tian)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye)時(shi)(shi)(shi)間累(lei)計不得(de)超過6小(xiao)時(shi)(shi)(shi),并盡量(liang)縮短(duan)室(shi)(shi)外(wai)連續(xu)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)時(shi)(shi)(shi)間,不得(de)安排(pai)(pai)(pai)勞動(dong)(dong)(dong)者(zhe)在(zai)當日(ri)(ri)(ri)氣(qi)(qi)溫(wen)(wen)最高(gao)(gao)時(shi)(shi)(shi)段(duan)3小(xiao)時(shi)(shi)(shi)內室(shi)(shi)外(wai)露(lu)天(tian)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye);日(ri)(ri)(ri)最高(gao)(gao)氣(qi)(qi)溫(wen)(wen)達(da)(da)到35℃以(yi)(yi)(yi)上(shang)、37℃以(yi)(yi)(yi)下時(shi)(shi)(shi),要(yao)采(cai)取(qu)換班輪休(xiu)等(deng)方(fang)式,縮短(duan)室(shi)(shi)外(wai)露(lu)天(tian)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye)勞動(dong)(dong)(dong)者(zhe)連續(xu)工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)時(shi)(shi)(shi)間,并不得(de)安排(pai)(pai)(pai)勞動(dong)(dong)(dong)者(zhe)加班。對不適(shi)宜高(gao)(gao)溫(wen)(wen)天(tian)氣(qi)(qi)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye)的勞動(dong)(dong)(dong)者(zhe)及時(shi)(shi)(shi)協商調整工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)任(ren)務,不得(de)安排(pai)(pai)(pai)懷(huai)孕(yun)女職工(gong)和(he)未成年工(gong)在(zai)35℃以(yi)(yi)(yi)上(shang)的高(gao)(gao)溫(wen)(wen)天(tian)氣(qi)(qi)下從事室(shi)(shi)外(wai)露(lu)天(tian)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye)及在(zai)33℃以(yi)(yi)(yi)上(shang)的工(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)場所(suo)作(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)(zuo)業(ye)。

   三、嚴格落實(shi)高溫津貼待遇

   根(gen)據(ju)本(ben)地區(qu)經(jing)濟社(she)會發(fa)(fa)展狀況,合理確(que)定(ding)并及時調整本(ben)地區(qu)高(gao)(gao)溫(wen)(wen)(wen)津(jin)貼(tie)標準(zhun),督促企業(ye)向符(fu)合條(tiao)件的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)發(fa)(fa)放高(gao)(gao)溫(wen)(wen)(wen)津(jin)貼(tie)。指導企業(ye)合理確(que)定(ding)高(gao)(gao)溫(wen)(wen)(wen)天(tian)氣下勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)工(gong)(gong)(gong)作(zuo)(zuo)量和勞(lao)(lao)動(dong)(dong)(dong)(dong)強度(du),不(bu)得因高(gao)(gao)溫(wen)(wen)(wen)天(tian)氣停工(gong)(gong)(gong)、縮短工(gong)(gong)(gong)作(zuo)(zuo)時間(jian)扣(kou)除(chu)或(huo)降低勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工(gong)(gong)(gong)資待遇。嚴格落實高(gao)(gao)溫(wen)(wen)(wen)津(jin)貼(tie)制度(du),高(gao)(gao)溫(wen)(wen)(wen)津(jin)貼(tie)應(ying)(ying)以(yi)法定(ding)貨幣形(xing)式(shi)按時足額發(fa)(fa)放給勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe),不(bu)得以(yi)發(fa)(fa)放清涼飲(yin)料、防暑(shu)降溫(wen)(wen)(wen)用品等(deng)實物或(huo)各類有價證(zheng)券代替。引導平臺企業(ye)對(dui)高(gao)(gao)溫(wen)(wen)(wen)天(tian)氣下接單的(de)(de)戶外勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)給予(yu)適當補(bu)貼(tie),并可采(cai)取延長配送(song)(song)時間(jian)等(deng)措施(shi),保(bao)障(zhang)網約配送(song)(song)、出行、運輸等(deng)新就業(ye)形(xing)態勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)生(sheng)命(ming)健康(kang)安全。對(dui)因高(gao)(gao)溫(wen)(wen)(wen)天(tian)氣作(zuo)(zuo)業(ye)引發(fa)(fa)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)發(fa)(fa)生(sheng)事故傷(shang)害或(huo)經(jing)職業(ye)病診斷機構診斷為職業(ye)性中(zhong)暑(shu)的(de)(de),應(ying)(ying)按規(gui)定(ding)依法認定(ding)工(gong)(gong)(gong)傷(shang)并落實相關保(bao)險待遇。

   四、加強(qiang)重點時段執(zhi)法檢查

   以室(shi)外露(lu)天作業(ye)的(de)建筑、物流、交通(tong)等為重(zhong)點(dian)行(xing)(xing)業(ye),以快(kuai)遞員、外賣送(song)餐員、環衛(wei)(wei)工等為重(zhong)點(dian)群體,加大(da)對企業(ye)遵守(shou)勞(lao)(lao)(lao)動(dong)保障法(fa)律法(fa)規(gui)情況的(de)監(jian)督檢查力度,督促企業(ye)落實高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)津(jin)貼支(zhi)付主體責(ze)任。暢通(tong)舉報(bao)投訴(su)(su)渠道(dao),對未按規(gui)定標準發(fa)(fa)放(fang)高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)津(jin)貼等行(xing)(xing)為的(de)投訴(su)(su)舉報(bao)線(xian)索及時處(chu)置,發(fa)(fa)現一起堅決查處(chu)一起。加強因高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)天氣(qi)(qi)作業(ye)引(yin)發(fa)(fa)的(de)勞(lao)(lao)(lao)動(dong)爭議(yi)案件(jian)調(diao)處(chu),暢通(tong)受理(li)(li)渠道(dao),實行(xing)(xing)快(kuai)立快(kuai)審快(kuai)結,及時有效(xiao)維護(hu)勞(lao)(lao)(lao)動(dong)者(zhe)合(he)法(fa)權益。加強與應(ying)急管理(li)(li)、衛(wei)(wei)生健(jian)康、工會組(zu)織(zhi)等部門(men)單位的(de)信息共享和(he)協調(diao)配(pei)合(he),共同分析研(yan)判高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)天氣(qi)(qi)勞(lao)(lao)(lao)動(dong)安(an)全(quan)形勢(shi),健(jian)全(quan)極端高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)天氣(qi)(qi)應(ying)急管理(li)(li)措(cuo)施(shi),不斷(duan)完善高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)天氣(qi)(qi)勞(lao)(lao)(lao)動(dong)防護(hu)、安(an)全(quan)生產、防暑(shu)降溫(wen)(wen)(wen)(wen)、高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)津(jin)貼等各項(xiang)制度,在高(gao)(gao)(gao)(gao)溫(wen)(wen)(wen)(wen)重(zhong)點(dian)時段(duan)聯合(he)開展(zhan)監(jian)督檢查專項(xiang)行(xing)(xing)動(dong),督促企業(ye)全(quan)面(mian)落實《防暑(shu)降溫(wen)(wen)(wen)(wen)措(cuo)施(shi)管理(li)(li)辦法(fa)》,保障勞(lao)(lao)(lao)動(dong)者(zhe)身體健(jian)康和(he)生命安(an)全(quan)。(人社部)
